Employment Practices Liability

Employment Practices Liability insurance provides cover for claims arising from a specified variety of employment related claims. Examples of the types of claims covered include:

  • unfair dismissal;

  • sexual harassment or workplace harassment;

  • discrimination;

  • breach of employment contract;

  • defamation from employment related matters; etc
As the labour force becomes better educated and aware of its rights, there will continue to be an increase in the number of employment practices liability claims. Regardless of the soundness of a company’s human resources practices, it is impossible to completely irradicate the risk that surrounds the employment relationship.

A survey done by the Human Rights and Equal Opportunity Commission (HREOC - 2004 National Survey Press Release – 24 March 2004) found that:

“In the survey, 28 per cent of adult Australians (41 percent Australian women and 14 per cent of men) stated that they have experience sexual harassment, with two-thirds experiencing sexual harassment at the workplace.”
